Relational contracting and good faith provisions

The concept of good faith leads to many intriguing judicial interpretations but often leaves us uncertain as to its impact on our legal commitments. Does it add clarity if certain construction contracts are seen as ‘relational contracts’ or ‘enterprise contracts’? If so, how do these types of contract make a difference in practice? Professor David Mosey of the King’s College London Centre of Construction Law and Shy Jackson of Pinsent Masons will offer us fresh insights into the common law treatment of good faith and the ways in which relational contracts and enterprise contracts could offer a way out of the woods.
