Joint 1st Prize: Serena Lee: An employer' (dis)entitlement to liquidated damages for delay where the contractor never completes: defending ‘orthodoxy’
The classic assumption that liquidated damages for delay will be payable for the period between the contractual date for completion and actual completion obviously cannot be simply applied in a situation where the contractor never achieves completion. The Triple Point Technologies case obliged the English courts to confront this issue in the context of existing authorities. The Joint First Prize Winners of the 2019 SCL Hudson Prize offer two differing perspectives on the significance of the Triple Point decision and how the law currently stands.
